Scope and object of the Online Shop General Conditions

These General Conditions are intended, with the order form, and the other items referred to therein, to regulate the terms and conditions that govern the provision of the Online Shop Service Ownever (hereinafter referred to as "Shop") by Ownever- Acessórios de Moda; Lda., headquartered at Rua dos Congregados, n33 4E, 4710-370 Braga under the single registration and identification of legal person No 515814385.

The shop consists of providing through the website www.ownever.com access to an online shop that allows the Customer to order products online in the terms and conditions described herein. 

Only with the acceptance of these terms will the agreement between Ownever and the Customer be formed.

The effective version in every moment of these General Conditions is available on the website www.ownever.com

 

 

Product Information and Content 

Ownever will do everything possible so that the information presented does not contain errors, and will be quickly corrected whenever they occur. If the Customer purchases a product that has different characteristics to the presented online, the Customer has the right to terminate the purchase agreement pursuant to the applicable law. Measures presented (size and weight) in the online store are approximate and may contain measurement errors.

Ownever will do everything possible to send all the products ordered, but it is possible that in certain cases due to causes hardly controllable by Ownever, as human errors or incidences in the computer systems, it is not possible to provide some of the products ordered for the Customer. If any of the products are not available after making the order, the Customer will be notified via e-mail or by phone.

If that occurs the Customer will be presented with the opportunity to cancel the order with the appropriate refund if the Customer has already made the appropriate payment.

The Customer may not demand from Ownever, other counterparts, interest or compensation, in addition to that of the return, in cases of break stocks or errors in the information provided on the site.

All price information, product specifications and promotional activities may be amended at any time by Ownever.

 

Consumer Obligations

The Customer undertakes to:

1)Provide correct personal data and addresses;

2) Do not use false identities;

Ordering products should be made by customers aged over 18 (eighteen) years. The data and information transmitted by the Customer shall enjoy the full legal effect, recognizing the customer the online shopping and cannot claim that lack of signature for breach of obligations.

If any of the data is incorrect or insufficient, and for this reason, there is a delay or inability in the order processing, or if non-delivery occurs, the responsibility is of the Customer, and the Ownever disclaims any responsibility. If the Customer violates any of these obligations, Ownever reserves the right to eliminate future purchases, block access to the store, cancel the provision of any other products available by Ownever, and also not allow the Customer future access to some or any services offered by Ownever.

 

Privacy and Personal Data Protection

Ownever guarantees the confidentiality of all data provided by customers.

The personal data identified in the order form as mandatory are essential to the operation of the store. The omission or inaccuracy of the data provided by the Customer is the Customer's sole responsibility and may give a reason for the refusal of service by Ownever.

Under applicable law, is guaranteed to the Customer, free of charge, the right to access, correct and update their personal data, directly or upon request by email to hello@ownever.com.

We use Brevo as our marketing platform. When you subscribe to our newsletter, you allow this information to be transferred to Brevo in accordance with their Privacy Policy. You can unsubscribe from the newsletter at any time in the footer of the newsletter you receive.

We may eventually advertise online and disclose your personal information to Google Inc. and Facebook Inc. in order to provide targeted ads. You can review the Google Terms of Service and Facebook Terms of Service.

The Internet is the open network, so the customer's personal data, other personal information and all content hosted on the Shop may run on the network without security, including the risk of being accessible and used by unauthorized third parties and Ownever cannot be held responsible for such access and / or use.

 

Portability of Personal Data


In accordance with European legislation, customers have the right to request a copy of their personal data in a structured format (e.g. CSV or JSON), as well as the right to request that this information be transferred to another service provider. Requests can be made at any time by contacting hello@ownever.com

 

Cancellation of orders:

 

1. At Customer's request 

The Customer may affect the cancellation of the Customer's order asking it to Ownever by email hello@ownever.com referring to the order number, which will be accepted provided that it has not yet been processed. After processing, Ownever will attempt to deliver the order, but the Customer has the option not to accept it.

For the purposes of cancellation, the Customer shall provide the following data to Ownever: a) Order number; b) Tax ID number that placed the order and delivery address.

 

2. By decision of Ownever 

The Ownever reserves the right to not process orders when checking some inconsistency in the personal data submitted or observe misconduct by the buyer. The Ownever reserves the right not to process of any order or refund, in case there are errors in the values and/or characteristics of the products when they arise from technical problems or errors unrelated to Ownever.

 

Return (Resolution Law)

The Customer can exercise the right of withdrawal without Ownever requiring any compensation within 30 (thirty) days from the day on which the Customer acquires physical possession of the property.

To exercise this right, the Customer must send the information below, duly completed, to the email address hello@ownever.com with the subject "Free Resolution"

For communicate this to solve my purchase and sale agreement for the following property: Product Name; Number Order / Invoice;  Requested on; Received; Customer name; Customer Address

The Customer must, within 30 (thirty) days from the date the resolution form was sent, return by registered mail, the goods to Ownever under appropriate conditions.

The package must be returned complete, as delivered and accompanied by all the documentation received, including the sales invoice. The package and documents must be sent by registered mail to the following address: Ownever, Lda – Rua dos Congregados, N33, 4E, 4710-370 Braga, Portugal. The Customer should always ask for the receipt proving the shipping of the package. Shipping costs will be the Customer's responsibility.

After receiving the return in Ownever will refund the Customer with the amount paid for the order (sales invoice amount, including shipping costs). If The Customer used a promotional discount code, this value will not be refunded.

The method of repayment of the amount to be returned depends on the payment method of the order respective. In the case of payments by credit card and PayPal, they are credited to their account. In other cases, when given IBAN information, the refund is made to the indicated bank account. The refund is made within 30 (thirty) days of receipt of the form of withdrawal and the goods returned.

In the absence of any components sold or if any of them is not in excellent condition, there will not be any refund and the product will be returned back to the initial shipping address. 


Warranty

In legal terms, Ownever items have a warranty of 3 years period from the date of invoice. The Ownever pieces are delicate so remember the main precautions: Avoid contact with water and abrasive products and clean it only with a soft, dry cloth.

Are considered outside the warranty conditions the items that have defects caused by abnormal wear, negligence or accidents and missing components.

If the Customer is facing any nonconformity, send an email with the subject "Guarantee" for hello@ownever.com, stating the order number, date of invoice and Customer address.

The Customer should then send the item, via registered mail to the following address: Ownever, Lda, Rua dos Congregados, n33, 4E 4710-370 – Braga, Portugal. The Customer should always ask for the receipt proving the shipping of the package. Shipping costs will be the Customer's responsibility.

After examination and confirmation of the validity of the guarantee, the product will be repaired or replaced at no charge and returned to the Customer's address.

 

Communications

Without prejudice to other forms of communication provided for in the General Conditions, the notifications made to the Customer that relate to the shop may be made to the email Customer's address, SMS or phone.

The Customer agrees to receive any communication and/or notification relating to the Online Shop to the address, contact number and or email address ("email") indicated in the ordering process.

At any time, the Customer can request not to receive these communications and/or notifications via the Contact Form or through the option "Unsubscribe" inscribed on each Newsletter.

  

SMS Marketing 

By consenting to Ownever’s SMS marketing in the checkout and initializing a purchase or subscribing via our subscription tools, you agree to receive recurring text notifications (for your order, including abandoned checkout reminders), text marketing offers, and transactional texts, including requests for reviews from us, even if your mobile number is registered on any state or federal do-not-call list. Message frequency varies. Consent is not a condition of purchase.

If you wish to unsubscribe from receiving text marketing messages and notifications, reply with "UNSUBSCRIBE" to any mobile message sent from us or use the unsubscribe link we provided you within any of our messages. You understand and agree that alternative methods of opting out, such as using alternative words or requests, will not be considered a reasonable means of opting out. We do not charge for the service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.

We have the right to modify any telephone number or short code we use to operate the service at any time. You will be notified on such occasions. You agree that any messages you send to a telephone number or short code we have changed, including any UNSUBSCRIBE or HELP requests, may not be received, and we will not be liable for honoring requests made in such messages.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Your right to privacy is important to us. You can see our Privacy Policy to determine how we collect and use your personal information. 

 

Dispute Resolution

The Customer may submit any contractual disputes, to the mechanisms of arbitration and mediation that are or may be legally constituted and lodge a complaint with Ownever of acts and omissions that violate the legal provisions applicable to the purchase of goods.

Applicable Law

The parties agree that their relations will be exclusively governed by these Terms and Conditions and the Information available on the site. In case of omission of any condition, this will be considered governed by habits and customs in force in distance selling practices, according to the provisions of the Code of Ethics and Loyal Practices of the AMD – Portuguese Association of Direct Marketing and other legislation in force. 

 

All products sold in Ownever Online Shop are in accordance with the Portuguese law.
